Human Rights Charters in Australia
by Peter Faris QC and Professor Mirko Bagaric
Victoria is the first state in Australia to enact a Bill of Rights. The Victorian Charter of Human Rights and Responsibilities Act 2006 will have a wide-ranging and profound impact on way the law is interpreted, applied and enforced in Victoria. The Charter is potentially the most significant statute to have been enacted in Victoria for over a century.
The Charter comes close on the heels of the Human Rights Act 2004 in the Australian Capital Territory. It is likely that Western Australia, Queensland and New South Wales will also enact a charter of rights in the foreseeable future.
Human Rights Charters in Australia examines the nature and scope of the Charters and draws on international and domestic case law, commentary and analysis to inform readers of the likely effect of the Charters. It suggests the manner in which key legal rules, principles and causes of action are likely to be re-defined and the implications that this will have for the remedies available to litigants and orders imposed in criminal and civil matters.
The book is an essential resource for lawyers, judicial officers, academics and students.
Peter Faris QC is a leading Australian criminal lawyer.
Professor Mirko Bagaric is the author of numerous books on law and philosophy.
